Terms & Conditions

1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.

2. The Promoter is FelTe Pty Ltd Trading as Fitness Forum Health Club ABN 36 185 204 127. 1/174 Green Valley Rd Green Valley.

Eligibility

3. Entry is open to anyone over 16 years of age.

4. Entrants must be over the age of 16 and must read and consent to these Terms and Conditions.

5. Only one entry per person will be allowed and it must contain the full description of all 4 locations of the signs.

6. The competition opens on Thursday the 1at August 2019 at 12:01am (AEST) and closes on Saturday the 31st August 2019 at 11:59pm(AEST). The Draw will take place on Sunday the 8th September 2019, at 1/174 Green Valley Rd Green Valley NSW 2168. The winner will be contacted via phone or in person. An announcement will be made  through Facebook and a notification of the winner's name will appear on a post on the Fitness Forum Facebook page. If we are unable to contact the winner of the competition within 2 weeks via phone or in person then they will forfeit all rights to any prizes and are not eligible to claim any form of compensation.  

How to Enter

7. To enter the competition, all entrants must describe the location of all 4 signs as shown on the competition page. You must include the street name it is on and the closest cross street to be eligible. You must have all these details in one entry form multiple entries with part answers will not be accepted.

8.  Without limiting any other terms herein, each entrant indemnifies the Promoter and its directors, officers, employees, and agents (the Indemnified Parties) on a full indemnity basis for all direct and consequential loss and damage and liabilities, whether monetary or capable of being converted into money, suffered by any of the Indemnified Parties, as a result of, or caused or contributed to by, any act or omission, including any breach of any of these terms and conditions, by the entrant.

The Prize

9. The Prize is a 6 month full access membership. This will be added to the end of the existing membership of the winner if they are a current member or will be set up as a new membership for any non member that enters.

10. This person must meet all the normal terms and conditions required to normally become a member of Fitness Forum Health Club. Fitness Forum Health Club has the right to deny membership to anyone if deemed unsuitable due to any reason whatsoever.

11. Prizes are not transferable or exchangeable and cannot be taken as cash. 

General

12. The Promoter's decision is final and binding, and no correspondence will be entered into.

13.  Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 

14. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition the Competition and Consumer Act, as well as under any other similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.

15. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry, or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.


16. This promotion is in no way sponsored by any other entity other than the Promoter.  The Promoter can cancel or modify the promotion at its discretion.
